Clear guidelines outlining our rights and responsibilities, ensuring a transparent, fair, and professional experience throughout every project.

These Terms & Conditions govern the use of [WEBSITE URL], the purchase of digital products, and all professional services provided by Anca-Gabriela Puscasu.

By purchasing a product, requesting a service, or entering into a project agreement with me, you confirm that you have read and accepted these terms.

Services and Digital Products

I provide product design, website design, website development, template customization, creative direction, and related digital services.

I may also sell digital products, including Framer templates, website templates, design resources, components, and other downloadable or duplicable materials.

All services and products must be used only for lawful and ethical purposes. Fraudulent, abusive, misleading, or illegal use may result in access being revoked or the project being terminated.

Client Responsibilities

Clients are responsible for providing:

• Accurate project requirements and business information
• Complete content, imagery, branding, and necessary assets
• Access to relevant platforms and accounts
• Timely, clear, and consolidated feedback
• Any required third-party licences or subscriptions

Missing information, delayed feedback, or unavailable access may affect the project timeline and delivery date.

Project Scope and Revisions

The scope, deliverables, timeline, price, and number of revision rounds for custom services are defined in the applicable proposal, scope of work, or contract.

Requests outside the agreed scope may require:

• Additional fees
• A revised timeline
• A separate project phase or agreement

Unlimited revisions are not included unless explicitly stated in writing.

Pricing and Payments

All prices are confirmed before work begins. The final project price depends on scope, complexity, number of pages, integrations, content, platform, technical requirements, and timeline.

Payments must be made according to the schedule stated in the proposal, invoice, or contract.

Work may be paused if a payment becomes overdue. Final files, website ownership, transfer access, or publication may be withheld until all outstanding amounts have been paid.

Project Timelines

I make reasonable efforts to complete projects within the agreed schedule.

Timelines may change due to:

• Delayed client feedback or approval
• Missing content, assets, or access
• Additional scope requests
• Third-party platform issues
• Technical problems outside my reasonable control
• Unforeseen circumstances

Any material timeline changes will be communicated as soon as reasonably possible.

Client Delays and Inactivity

If the client becomes unresponsive or does not provide required feedback, materials, or approvals, the project may be paused and the delivery date rescheduled.

Extended inactivity may result in the project being closed. Any payments already made remain subject to the signed agreement, completed work, and time reserved for the project.

Cancellation of Custom Services

If a client cancels a project after work has started, deposits and completed milestone payments are non-refundable, except where required by applicable law or expressly stated otherwise in the signed agreement.

The client remains responsible for:

• Work completed before cancellation
• Approved project stages
• Time already reserved or used
• Non-recoverable third-party expenses
• Any cancellation terms included in the contract

Any unfinished or unpaid work remains my property.

Digital Product Licence

Unless a different licence is provided with the product, purchasing a digital template or resource grants the buyer a limited, non-exclusive, non-transferable licence to use it for one personal or commercial end project.

The buyer may customize the product for their own website or for one end client.

The buyer may not:

• Resell, redistribute, share, sublicense, or republish the product
• Claim the original template or resource as their own creation
• Include it in another template, product, course, membership, or resource library
• Make the source files publicly available
• Duplicate the product for multiple projects without purchasing the required additional licence

The product and its original design remain my intellectual property.

Refund Policy for Digital Products

Because digital products provide immediate access to downloadable, duplicable, or reusable content, purchases are considered final once access, duplication, or download has begun, except where mandatory consumer law provides otherwise.

Refunds are not offered for:

• Change of mind
• Accidental purchases
• Failure to read the product description or requirements
• Lack of experience with Framer or another required platform
• Incompatibility that was clearly disclosed before purchase
• Issues caused by the buyer’s modifications
• Issues caused by unsupported plugins, custom code, or third-party services
• Failure to use or complete the purchased product

Where legally permitted, by requesting immediate access to a digital product, the buyer expressly consents to immediate delivery and acknowledges that the statutory right of withdrawal may be lost once access or delivery begins.

Defective or Broken Digital Products

A digital product is considered defective only when it materially fails to operate as described in its supported platform and the issue existed in the original product.

If a product appears to be defective, the buyer must contact me at ancagabrielauiux@gmail.com and provide:

• The order or purchase information
• A clear description of the issue
• Screenshots or a screen recording
• Relevant device, browser, or platform information

My first remedy will be to investigate and, where the issue is confirmed, repair, replace, or provide corrected access to the product within a reasonable period.

A refund will not be provided when:

• The reported issue is successfully repaired
• A working replacement is provided
• The problem was caused by buyer modifications or misuse
• The product works as described
• The issue relates to a disclosed limitation
• The problem originates from an unsupported third-party integration

If a confirmed defect cannot be repaired or replaced within a reasonable time, any mandatory remedies required by applicable consumer law will remain available. Nothing in these terms limits rights that cannot legally be excluded.

Third-Party Marketplaces and Platforms

Products or services purchased through Framer, another marketplace, or a third-party payment platform may also be subject to that platform’s terms, licence conditions, payment rules, and refund procedures.

Where mandatory marketplace rules conflict with these terms, the applicable marketplace rules may control the transaction.

Clients are responsible for third-party costs such as hosting, domains, plugins, fonts, stock assets, platform subscriptions, and external services unless explicitly included in the project scope.

Ownership and Portfolio Rights

For custom services, ownership of the final approved deliverables transfers to the client only after full payment.

Concepts, drafts, rejected directions, unused materials, internal systems, reusable components, processes, and working methods remain my property unless otherwise agreed in writing.

I reserve the right to display completed work in my portfolio, case studies, social media, and promotional materials unless a confidentiality agreement or written restriction has been agreed before the project begins.

Support and Maintenance

Post-launch support, maintenance, updates, technical assistance, or ongoing design services are included only when stated in the applicable proposal or agreement.

Additional requests made after project completion may be quoted and billed separately.

Digital product support covers confirmed issues with the original product. It does not automatically include customization, platform training, content entry, third-party integration setup, or repairs following buyer modifications.

Right to Refuse or Terminate Services

I reserve the right to refuse, pause, or terminate a project where a client:

• Violates these terms or the signed agreement
• Fails to make required payments
• Engages in abusive, fraudulent, illegal, or unethical conduct
• Repeatedly exceeds the agreed scope
• Misuses or redistributes intellectual property
• Fails to provide the information required to continue the project

Any payment and ownership consequences will be handled according to the signed agreement and applicable law.

Limitation of Liability

I am not responsible for losses caused by third-party platforms, hosting providers, plugins, integrations, platform updates, service interruptions, cybersecurity incidents, or changes made after delivery by the client or another provider.

I do not guarantee specific commercial outcomes, revenue, traffic, rankings, conversions, funding, or business growth.

Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.

Governing Law

These terms are governed by the laws of Romania, without limiting any mandatory consumer protections that may apply in the buyer’s country of residence.

For custom projects, the governing law and dispute provisions contained in a signed contract take priority where applicable.

Changes to These Terms

These terms may be updated when services, products, business practices, platform requirements, or applicable laws change.

The version displayed at the time of purchase or project agreement applies to that transaction unless otherwise required by law.
